Use of the website shall be deemed to be your agreement to abide by each of the terms of this agreement and deems these terms are binding. The terms may be updated from time to time with or without notice to you. Your continued use of the website indicates acceptance of any modifications to the terms. Possible reasons for cancellation may include, but are not limited to, information provided by payment gateway failing to match membership profile, any appearances of inappropriate use of the site including harassment, stalking or sending of gifts to recipients who return to sender.
Payment Terms
Payment must be made at the time of purchase using the payment gateways offered on the website. Your order is subject to cancellation by the company, at the company’s sole discretion.
Errors and Omissions
The company is not responsible for pricing, interpretation of descriptions, or other errors, in any offer by the company and reserves the right to cancel any orders resulting impacted by such errors at the companies sole discretion.
Shipping Terms
Packaging, shipping and handling unless otherwise stated at the time of sale. Loss or damage that occurs during shipping by a carrier selected by chocolatedelivers.com is the shipping company’s responsibility. All orders are delivered by Canada Post or US Postal Service any claims for loss or damage after the order has left our hands must be made through the shipper. We will provide confirmation of shipping date.
It is your responsibility to cover any additional charges by the shipping company for re-delivery or re-routing due to address changes. It is your responsibility to notify us a minimum of 30 days in advance for any change of address and not later than the first of the month for the following month’s shipment.
Shipping dates are estimates only.
Returns, Refunds and Cancellations
All merchandise purchased from the Company may be returned to the Company for a full refund or replacement within 10 days of delivery provided that merchandise is returned in its original condition and in its original packaging. The customer is responsible for any shipping costs to return product.
No merchandise will be accepted for replacement or refund after this 10 day period and all sales will be considered final.
You may cancel your ongoing membership for a refund of the remaining shipments at any time by sending an email and a scanned copy of your original receipt, method of payment and charge card information (must match information on original order), to the company at chocolatedelivers@gmail.com. All cancellation requests must be received by the first day of the month. Cancellation requests received after the first of the month shall apply to the following month.

You agree to check the website for notices, and that you will be considered to have received a notice when it is made available to you by posting on the website.
Disclaimer of Warranties
chocolatedelivers.com strives for accuracy in the website and does not warrant against interruptions of technical functions or issues relating to payment gateway rules or policies. We strive to keep the site and ordering system functioning.
Your use of the website is at your own risk. We strive to have a virus free website however, as some technical events cannot be protected against we are not responsibility for any costs incurred as a result of such episodes.
Limitation of Liability
chocolatedelivers.com and its suppliers are not liable for any direct or indirect, special or consequential damages arising out of using the website or through consuming products. Products may contain nuts, milk, wheat, soy, peanuts or other known allergens. It is the responsibility of persons suffering from allergens not to consume products from chocolatedelivers.com which may contain these products. While we allow you to request no nuts, or no peanuts, these ingredients are used in the same facility where products are made and this must be considered by persons who have severe allergies.
chocolatedelivers.com and/or its suppliers are not under any circumstances liable for any indirect, punitive, incidental, special, consequential damages or any damages whatsoever arising out of the use of the website, whether based on contract, tort, negligence, strict liability or otherwise, even if chocolatedelivers.com or any of its suppliers has been advised of the possibility of damages.
If you are dissatisfied with any of these terms, product offerings, pricing, or any other aspect of chocolatedelivers.com, leave this website and do not use this website. Failure to read and observe the terms laid out here does not directly or indirectly absolve you from the terms and conditions herein, which govern the use of this website. Ordering from this website implies acceptance of all the terms in this agreement.
Termination of your Account
chocolatedelivers.com reserves the right to suspend the account of a customer who fails to notify us of changes of addresses if and when it results in additional shipping charges incurred by return shipping by the shipper. chocolatedelivers.com will terminate or suspend an account which if IP address of spam or similar activities against the site is the same as the IP address showing on your order, or credit card/billing address conflicts or similar questionable activity. Termination will be made at chocolatedelivers.com’s sole discretion and is not liable to you or any third party for termination of your account or access to the website.
Force Majeure
chocolatedelivers.com is not responsible for (a) any provision of any present or future law or regulation, (b) any act or omission of a third party, or (c) any act of God, emergency condition, war, computer or telecommunications failure or other circumstance beyond the control of chocolatedelivers.com
Governing Law
This agreement and any sales there under shall be governed by the laws of the Province of British Columbia, without regard to conflicts of laws rules.
